Key points of a lease agreement for owners

A good lease protects both the owner and the tenant. Here is what to agree on.

Key points of a lease agreement for owners

In Estonia, residential leases are governed by the Law of Obligations Act (võlaõigusseadus). Clearly written terms prevent most later disputes.

What to agree on

  • rent amount, due date and bank account;
  • utilities: who pays them and how;
  • deposit amount and how it is returned;
  • lease term and notice rules;
  • pets, smoking and subletting;
  • condition of the property at handover.

Handover certificate

At handover, draw up a certificate with photos and meter readings. It is the best evidence if questions about the condition come up when the lease ends.

For residential leases, the deposit may not exceed three months' rent.

We can draw up the lease and handover certificate for you. Ask for an offer.
